What is a Trust?
A trust is a legal arrangement in which a person (grantor) places property with another person (trustee) to be managed for the benefit of one or more individuals (beneficiaries). A trust is created via a trust document which may describe how the assets are to be managed and how or when distributions are to be made.
Why do people establish a Trust?
Trusts are often thought of as an estate tax saving tool for only the very wealthy. Nothing could be farther from the truth. Trusts have many uses. Trusts are established as a matter of convenience for financial record keeping or for assistance in making investment decisions. Trusts can help to ensure that separate property retains its separate character. Trusts may be used to protect assets from a beneficiary that does not handle money well, or to shift income from a person with high income to lower income dependents, thus reducing income taxes. Trusts can provide asset protection and continuity of management in the event of incapacity. Trusts can also be used to avoid the costs and delays of probate. And yes, trusts can reduce or possibly even eliminate the federal estate tax burden.
